Dana represents executives and professionals in negotiating employment and separation agreements, with a special eye toward securing pay equity, mitigating the effects of non‑compete and mandatory arbitration agreements, and obtaining the most favorable terms possible in severance negotiations. She also litigates on behalf of clients who have experienced sexual harassment, a hostile work environment or discrimination on the basis of race, sex, age, disability or other protected class. This includes those treated differently because of sexual orientation or gender identity. Dana represents clients who have suffered wage theft or other improper pay practices, with the aim of recovering their losses — plus liquidated damages — in federal court. She has served as lead counsel in class action litigation concerning race discrimination and ERISA litigation. She also represents unions in all aspects of labor relations, including contract negotiations, handling complex arbitrations, representation and unfair labor practice proceedings before the National Labor Relations Board and other agencies, and litigation in state and federal court. Dana also provides strategic advice to labor union clients to help them achieve their objectives without litigation.

Case Highlight

  • United States and Vulcan Society, et al. v. City of New York, et al., No. 07-2067 (E.D.N.Y.) A historic class action litigation on behalf of thousands of black firefighter applicants who were found to be the victims of a discriminatory hiring process by the City of New York. We secured job offers for hundreds of victims, retroactive pay and compensatory damages amounting to more than $85 million, and widespread changes within the FDNY concerning its hiring process and the recruitment and retention of black firefighters going forward
