Levy Ratner’s Micah Wissinger and Robert H. Stroup, on behalf of Oklahomans for Equality, an Oklahoma LGBT advocacy group, filed an amicus brief in the Fifth Circuit in support of the Transgender Legal Defense and Education Fund. They argue that the state of Oklahoma should be exempted from an injunction that blocked an Obama administration guidance that students be allowed to use restrooms that match their gender identity, saying the directive conflicted with no Oklahoma law. The brief was filed as the Fifth Circuit considers whether to uphold the decision of a district court in Texas which enjoined agency guidance to schools declaring that under Title IX of the education code, discrimination against transgender students is sex discrimination.
